Interpretation and Definitions

Definitions

For the purposes of these Terms and Conditions:

  • Company (referred to as “the Company”, “We”, “Us”, or “Our”) refers to FM Lab, fmlabofficial.com.

  • Country refers to: Italy.

  • Goods refers to the handmade and customized items offered for sale on the Website.

  • Orders means a request by You to purchase Goods from Us.

  • Service refers to the Website fmlabofficial.com.

  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.


Acknowledgment

These Terms and Conditions govern the use of this Service and the agreement between You and the Company. By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms, You may not access the Service.

You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.


Placing Orders

By placing an Order for Goods through the Service, You warrant that You are legally capable of entering into binding contracts and that the information You provide is true, correct, and complete.


Order Cancellation by the Company

We reserve the right to refuse or cancel Your Order at any time for reasons including but not limited to:

  • Goods availability

  • Errors in the description or prices for Goods

  • Errors in Your Order

  • Suspected fraud or unauthorized/illegal transaction


Your Order Cancellation Rights

In accordance with Article 59 of the Italian Consumer Code and EU consumer law, the right of withdrawal does not apply to the supply of goods that are made to Your specifications or clearly personalized.

All FM Lab products are handmade, created on demand, and customized for each client. For this reason:

  • Once an order has been confirmed, it cannot be cancelled, returned, or refunded.

  • Minor variations from product photos and descriptions are to be expected due to the handmade nature of the Goods and shall not be considered defects. Examples include slight differences in color, size, or design placement.

  • All Goods are carefully inspected and verified before shipment. Once the Order has been shipped, the Goods are considered final and in perfect condition. FM Lab shall not be responsible for any alleged defects claimed after shipment.


Customer-Supplied Items

If You provide Your own garment or other personal item to be customized by Us, You acknowledge and accept that:

  • Such item is unique and cannot be replaced.

  • While all shipments are insured, in the event of loss or damage caused by the carrier, FM Lab’s liability shall be strictly limited to the amount refunded by the carrier’s insurance. No replacement, remake, or additional compensation will be provided for the loss of the original item supplied by the Customer.

  • FM Lab is not responsible for pre-existing damages or wear on items provided by the Customer.


Prices and Payments

  • Prices are listed on the Website and may be updated at any time before an Order is accepted.

  • Payment is required in full at the time of purchase.

  • Payments can be made through the methods available on the Website (e.g., PayPal or other online processors).


Shipping, Delivery, and Customs

  • Delivery times are estimates only and may vary depending on destination.

  • All shipments are insured against loss or damage during transit. In case of proven loss or damage attributable to the carrier, FM Lab will support the Customer in filing the claim with the carrier and will transfer any compensation received.

  • International orders may be subject to import duties, customs fees, and taxes. These charges are the responsibility of the Customer.


Delivery Issues and Customer Responsibilities

Customer Availability
The Customer is responsible for being available to receive the shipment at the delivery address provided. FM Lab shall not be responsible for delays or additional costs incurred due to the Customer’s unavailability.

Incorrect or Incomplete Addresses
The Customer is responsible for providing a complete and accurate shipping address. FM Lab shall not be liable for non-delivery, delays, or loss caused by incorrect, incomplete, or outdated addresses. Any additional shipping costs will be borne by the Customer.

Unclaimed Packages at Delivery Points
If the Customer provides a pickup point (e.g., locker, UPS Access Point) and fails to retrieve the package within the time frame specified by the carrier, the package may be returned to FM Lab. FM Lab shall not be responsible for lost or unclaimed items, and the Customer will remain responsible for the original Order. Any costs for reshipping the Goods will be charged to the Customer.

Proof of Delivery
FM Lab uses trackable shipping services. Tracking information provided by the carrier is considered conclusive evidence of attempted or successful delivery.

Force Majeure
FM Lab is not responsible for delays caused by events beyond Our control, including but not limited to natural disasters, strikes, or customs delays.


Intellectual Property

All content on the Website, including images, designs, logos, and text, is the exclusive property of FM Lab and is protected by copyright and other intellectual property laws. You may not use Our intellectual property without prior written consent.

FM Lab reserves the right to publish images of completed products on Our website and social media channels, even if the products are personalized.


Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with the use of Our Goods or Services.

Our liability shall in any case be limited to the amount You actually paid for the Order.

Nothing in these Terms shall limit Our liability in cases of willful misconduct or gross negligence, or for damages resulting from injury to life, body, or health.


Privacy and Data Protection

Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Italy, without regard to conflict of law provisions.

Changes to These Terms
